3. User Accounts

To use our services, you must create an account and provide accurate, complete information. You are responsible for:

  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Ensuring you have permission to scan the websites you add

4. Acceptable Use

You agree to use our services only for lawful purposes and in accordance with these terms. You agree not to:

  • Use the service to scan websites you don't own or have permission to test
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the service
  • Use the service for malicious purposes
  • Violate any applicable laws or regulations

5. Subscription and Payment

Our services are offered on a subscription basis with different pricing tiers:

  • Free tier: Limited features, no payment required
  • Paid tiers: Monthly or annual billing through Stripe
  • All fees are non-refundable except as required by law
  • Prices may change with 30 days notice

6. Service Availability

We strive to maintain high service availability but cannot guarantee uninterrupted access. We may:

  • Perform maintenance that may temporarily affect service
  • Update or modify the service
  • Suspend service for violations of these terms

7. Intellectual Property

SecAbly retains all rights, title, and interest in and to the service, including all intellectual property rights. You retain ownership of your website content and scan results.

9. Disclaimers

THE SERVICE IS PROVIDED 'AS IS' WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties that the service will be error-free or uninterrupted
  • Warranties regarding the accuracy of scan results

Security scanning cannot guarantee complete protection against all vulnerabilities. You remain responsible for implementing appropriate security measures.

10. Limitation of Liability

IN NO EVENT SHALL SECABLY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE.

Our total liability shall not exceed the amount paid by you for the service in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless SecAbly from any claims, damages, or expenses arising from your use of the service or violation of these terms.

12. Termination

Either party may terminate this agreement at any time:

  • You may cancel your subscription at any time
  • We may terminate for violations of these terms
  • Upon termination, your access to the service will cease
  • We may retain data as required by law or for legitimate business purposes

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these terms or the service shall be resolved through binding arbitration in San Francisco, California, in accordance with the rules of the American Arbitration Association.

15. Changes to Terms

We may modify these terms at any time. We will notify you of material changes by email or through our website. Your continued use of the service after such changes constitutes acceptance of the updated terms.
